1. Introduction and acceptance
These Terms of Service (ToS) govern the use of the Tipster4You platform accessible at https://Tipster4You.com. By accessing it, you accept all the conditions described below.
Tipster4You reserves the right to modify these ToS at any time. Changes will be notified on the site or by email.
2. Service description
Tipster4You is a platform allowing Tipsters to sell sports predictions to Clients. Sales can be done through:
- Pay-Per-Win: The Client is charged only if the prediction is winning.
- Pay-Per-View: The Client pays directly to view the prediction, regardless of the result.
- Subscription: The Tipster can offer a periodic subscription to access their predictions.
Payments are made exclusively via Stripe and PayPal for Tipsters validated by Tipster4You.
3. Registration and account management
Registration is mandatory to access Tipster4You services. Only validated Tipsters can sell predictions. Tipster4You reserves the right to refuse or delete an account in case of non-compliance with these ToS.
4. Commissions and subscriptions
Tipster4You offers three subscription plans for Tipsters:
- Free: 28% commission per sale.
- Business: 9% commission per sale.
- Premium: 3% commission per sale.
5. Email usage
Tipster4You may use users' email addresses to send them newsletters, promotional offers or service-related information, with their consent.
6. Pay-Per-Win Refund System
The Pay-Per-Win system ensures you are only charged if the prediction is winning. Here's the detailed operation:
Stripe Fee Policy
⚠️ IMPORTANT NOTE
Stripe transaction fees are NOT refundable, even for losing predictions.
These fees are collected by Stripe at the time of initial transaction and cannot be recovered by Tipster4You or yourself.
Stripe rates:
- EEA cards (European Economic Area): 1.5% + €0.25
- UK cards: 2.5% + €0.25
Example: For a €10 prediction with an EEA card, if the prediction loses:
- Refunded amount: €10 (prediction amount)
- Non-refundable Stripe fees: ~€0.40 (1.5% + €0.25)
- Total user cost: €0.40 (transaction fees)
How refunds work
- Purchase: Pre-authorization of total amount via Stripe
- Result validation: Automatic verification after event ends
- Winning prediction: Full charge (prediction + commissions)
- Losing prediction: Full refund of prediction amount
- Postponement/Cancellation: Full refund of prediction amount
Refund Timeline
- Winning predictions: Immediate charge after validation (24-48h)
- Losing predictions: Automatic refund (3-5 business days)
- Complex cases: Manual processing within maximum 7 days
Exception Cases
No refund is possible if:
- Event is postponed but occurs within 72 hours
- Prediction is winning (normal charge)
- User cancels purchase before validation
- Account is suspended for CGU violation
7. Intellectual Property
Content Ownership
Tipster4You and its partners own all intellectual property rights on the platform, including:
- The design, architecture and source code of the platform
- Logos, trademarks, graphics and visual elements
- Texts, articles, analyses and editorial content
- Databases, algorithms and recommendation systems
- Associated patents, trademarks and copyrights
User-Generated Content
By publishing content on Tipster4You, you grant a worldwide, non-exclusive, free and perpetual license for:
- Display, distribute and promote your content on the platform
- Adapt, modify and translate your content for accessibility
- Use your content for statistical and improvement purposes
- Include your content in case studies and demonstrations
You retain all rights to your original content and can delete it at any time.
Prohibited Uses
It is strictly forbidden to:
- Copy, reproduce or redistribute content without authorization
- Use robots or scrapers to extract data
- Reverse-engineer or decompile the platform code
- Create derivative works based on our content
- Commercially exploit our content without a license
9. User Conduct and Obligations
Acceptable Use
By using Tipster4You, you commit to:
- Provide accurate and up-to-date information
- Respect other users and staff
- Use the platform for legal purposes only
- Not attempt to compromise system security
- Respect others' intellectual property rights
- Cooperate with investigations when issues are reported
Prohibited Behaviors
- Create multiple or fake accounts
- Harass, threaten or verbally abuse other users
- Publish illegal, offensive or defamatory content
- Attempt to gain unauthorized access to accounts
- Use malware or viruses
- Spam or send unsolicited communications
- Share third-party confidential information
- Bypass security measures or restrictions
Consequences of Violations
- Formal warning and request for correction
- Temporary account suspension (7 to 30 days)
- Permanent suspension and account deletion
- Reporting to relevant authorities if necessary
- Legal action for damages and compensation
- Blocking of concerned IP addresses and devices
10. Account Management and Security
Account Responsibility
You are solely responsible for:
- Confidentiality of your login credentials
- All activities performed from your account
- Security of your devices and connections
- Immediate notification in case of compromise
- Regular updates of your information
Security Requirements
Your password must contain:
- At least 8 characters
- Combination of letters (uppercase and lowercase)
- At least one number
- At least one special character (!@#$%^&*)
- Not contain obvious personal information
Two-factor authentication is strongly recommended for tipster accounts.
Account Termination
You can terminate your account at any time through account settings.
Tipster4You may terminate an account for:
- Repeated violation of ToS
- Fraudulent or illegal activity
- Prolonged inactivity (more than 24 months)
- GDPR consent withdrawal request
- Compelling security or compliance reason
After termination, your data will be retained according to legally required periods.
11. Payments and Billing
Payment Processing
All payments are processed by Stripe, our trusted partner.
Stripe is PCI DSS Level 1 certified, the highest level of payment security.
Accepted methods: Credit/Debit cards, Apple Pay, Google Pay, bank transfer.
Subscription Billing
Subscriptions automatically renew at the end of each billing period.
Cancellation takes effect at the end of the current billing period.
Any price changes will be notified 30 days before implementation.
In case of payment failure, we will attempt 3 times over 10 days before suspension.
Refunds and Disputes
Refunds are processed according to the specific policy for each service type.
Payment disputes (chargebacks) must be handled directly with your bank.
Tipster4You will provide all necessary evidence in case of payment disputes.
Refund processing fees are charged to the user unless it's our error.
12. Applicable Law and Jurisdiction
These ToS are governed by French law.
Compliance with: GDPR, ePrivacy Directive, Monetary and Financial Code, Law n°2010-476.
In the event of a dispute, and failing an amicable settlement, the French courts shall have jurisdiction. If you are a consumer, you may also bring proceedings before the courts of your place of residence, and you retain the protection of the mandatory provisions of the law of your country of residence.
Before taking any legal action, you may refer the matter free of charge to the consumer mediator (see the Legal Notice). This option is voluntary and does not deprive you of your right to go to court.
If a clause is deemed invalid, other clauses remain in effect.
These ToS constitute the entire agreement between the parties.
13. Regulatory Compliance
Tipster4You Regulatory Status
Tipster4You is NOT an online gambling site. We are a sports content marketplace.
Our business model:
- Sale of sports analyses and predictions
- Connecting experts with clients
- Commission on content sales
- No sports betting, no money deposits
We sell sports information, not gambling services. Clients can use our predictions at licensed bookmakers, but not on our platform.
Tipster Verification and Fraud Prevention
Tipster4You is NOT a betting site - no bets are placed on our platform. We only sell sports analyses and predictions.
Mandatory verification for tipsters:
- Identity verification carried out by Stripe when payments are activated
- Bank account in the tipster's name to receive payouts
- Completed profile (bio and sports covered) before any publication
For clients (prediction buyers):
- No money is deposited on our site: only content is purchased
- No direct betting - purchase of informational content only
Responsible Content Consumption
Tipster4You does not offer money games. We sell sports analyses. However, we encourage responsible consumption:
- Purchase limits for predictions: 500€/day maximum
- Spending alerts for heavy buyers
- Clear information that predictions are not winning guarantees
- Links to gambling help resources
- Staff training to identify risky behaviors
Advertising Rules for Sports Analysis
As seller of sports analysis, we must follow specific rules:
Prohibited:
- Advertising targeting minors
- Guaranteed profit promises via our predictions
- Presenting predictions as financial solution
- Aggressive or misleading advertising
- Using testimonials without verifiable proof
Required:
- Mention 'Sports predictions involve financial risks'
- Minimum age 18 years
- Help contact information (for those who bet elsewhere)
- No dramatization of exceptional wins
- Clarity that we sell analysis, not betting services
